YUMCITI PROVIDES ONLINE ORDERING SERVICES FOR RESTAURANTS AND A MERCHANT APPLICATION FOR PARTICIPATING RESTAURANTS.

THIS POLICY EXPLAINS HOW YUMCITI HANDLES PERSONAL INFORMATION WHEN YOU USE OUR SERVICES.

The terms “Yumciti,” “we,” “us,” and “our” refer to Yumciti. “You” and “your” refer to users of our Services, including customers and authorized restaurant personnel.

This privacy notice describes how and why we might collect, store, use, and/or share your information when you use our services such as when you:

• Visit our website at yumciti.com, or any website of ours that links to this privacy notice.
• Use the Yumciti merchant mobile application to receive, view, print, and manage restaurant orders (for authorized restaurant personnel).
• Engage with us in other related ways, including any sales, marketing, or events.

1) What information is Collected?

When you visit, use, or navigate our Services, we may process personal information depending on how you interact with our Services, the choices you make, and the products and features you use.

When you create an account directly or through a participating restaurant website, we collect information necessary for account registration, authentication, and management.

This information may include the following:

• Profile and Account Information: When you register with an email address or sign in using Google, we may collect your name, email address, account credentials or authentication identifiers, and information needed to manage your account. Google Sign-In may provide your name, email address, and account identifier.
• Contact Information: This includes name, address, email address, phone number and other contact information.
• Age-Restricted Products: Orders containing alcohol may display a warning that purchasers must be 21 or older. The restaurant may require a valid government-issued photo ID for in-person age verification at pickup. Yumciti does not currently collect or store identification documents for this purpose.
• Payment and Delivery Information: We process payment-related information necessary to complete orders. To support saved payment methods and transaction records, Yumciti retains a payment method unique identifier (GUID) and the last four digits of the payment card. Yumciti does not store full card numbers or card security codes (CVV). Delivery information may include an address and delivery instructions.
• Communications: Including contact between customer and merchant or customer and delivery driver or any contact to us via sms, email, or phone.
• Transaction Information: Including customer name, time and date, amount, goods or services ordered.
• Location Information: If you have agreed to share your location we may receive and store your location information. You may use our services without sharing your location but it may affect your overall experience.
• Log Files: Including your browser type, IP address, pages visited, related domains and other search terms.
• Information from Third-Party Authentication: If you sign in using Google, we may receive basic Google account information such as your name, email address, and account identifier to authenticate and manage your account.
• Cookies: We utilize Cookies to provide our Service and assist in gathering data. Cookies may be used for purposes such as: sign-in and authentication, maintaining Service integrity, saving your preferences and settings, and evaluating the performance of our Service. If you wish to disable cookies, you can modify your browser settings to block the automatic acceptance of cookies. Please be aware that some features of Yumciti, including the website, applications, or services, may become unavailable if cookies are disabled.
• Push Notifications: We may ask for your permission to send you push notifications about your account or updates related to the Application. If you prefer not to receive these notifications, you can disable them through your device's settings.

2) How is the Data used?

• Customer Support: This includes exchanging communications, investigating, analyzing, and resolving support issues, such as those related to order delivery. It also involves assessing our customer support performance, implementing improvements, and ensuring that support matters are addressed in line with our internal standards, processes, and requirements, as well as in compliance with applicable laws.
• For Security: We use information to protect accounts and payments, investigate fraud or misuse, and protect customers and merchants. For alcohol orders, we may show an age warning; restaurants may verify identification in person. Yumciti does not currently collect or store ID documents for this purpose.
• To Promote Our Services: We may create and manage advertising campaigns on third-party platforms for participating restaurants at their request. Yumciti and participating restaurants may also send promotional offers, discounts, or coupons by text message or email where permitted by law and with any required consent. Recipients may opt out of marketing communications using the available opt-out method.
• To Improve Our Services: This includes understanding how customers interact with our Services and their preferences, resolving issues with our Services, and creating new features or initiatives to deliver the best possible experience for our users.

3) Data Disclosure

In certain situations, we may disclose or share information. It may be disclosed in the following ways:

• Delivery Drivers: To facilitate the delivery of your orders, we share certain information with delivery drivers, including the recipient's name (e.g., first name and last initial), delivery address, phone number, order details, and any provided delivery instructions.
• Merchants: We disclose Personal Information to Merchants as part of providing our Services, including, but not limited to, sharing information for order preparation, delivery, and safety purposes (ex: for age-restricted products). If you choose to link your account with a Merchant’s loyalty program, we may share relevant Personal Information to facilitate that connection. By placing an order, you acknowledge and agree that if the Merchant handles the delivery, they may use your Personal Information to complete the delivery (including contacting you via phone calls, emails, or SMS/text messages about the order and delivery). The Merchant is solely responsible and liable for any communications they initiate or send to you.
• Third Parties or Service Providers: We may share your information with third-party service providers who perform functions on our behalf, such as payment processing, email delivery, hosting services, customer support, and marketing assistance. Marketing communications may be sent by Yumciti or participating restaurants where permitted by law and subject to required consent and opt-out rights.
• Marketing Communications: Participating restaurants may use customer contact information for promotional messages, subject to applicable law, consent requirements, and opt-out rights. Yumciti does not currently use customer ordering or browsing information for cross-context behavioral advertising through third-party advertising platforms.
• Law Enforcement or Authorities: If we believe it is necessary to release information about you to comply with legal processes, address or remedy potential violations of our policies, or protect the rights, property, or safety of others, we may disclose your information as permitted or required by applicable laws, regulations, or rules. This may include sharing your Personal Information, such as details about your interactions with our Services, with third parties like government authorities, industry peers, or other entities. Such disclosures may be legally mandated or deemed necessary to enforce our agreements, prevent fraud, or safeguard the rights, property, and safety of our business, employees, merchants, delivery drivers, customers, or other individuals. These disclosures may also involve lawful access by U.S. or foreign courts, law enforcement, or other government authorities.
• Partners and Affiliates: We may share your information with our partners to provide you with certain products or services that have been developed or will be offered through a collaboration between our partners and us.
• Merger, Sale, or Acquisition: If Yumciti undergoes a merger, acquisition, sale, restructuring, bankruptcy, or transfer of business assets, customer information may be transferred to an acquiring or successor entity, subject to applicable privacy laws and legal requirements.

Merchant Application and Customer Order Information

Yumciti provides a merchant mobile application for participating restaurants and their authorized employees to receive, view, print, process, and manage customer orders. The merchant application is for restaurant personnel, not for customers to place orders.

Through the merchant application, authorized restaurant personnel may access customer names and phone numbers associated with orders; current and historical order details, including ordered items, quantities, totals, and order status; and delivery addresses for delivery orders. Delivery addresses are not provided as part of pickup-order information in the merchant app.

The merchant application retrieves this information from Yumciti's servers when needed for order preparation, fulfillment, delivery coordination, customer service, and restaurant operations. Customer order records are maintained on Yumciti's servers. The merchant application does not maintain a separate local database or cache of customer order information on the device.

Access to order information is intended for authorized restaurant personnel. Participating restaurants are responsible for handling information they access in accordance with applicable privacy and data protection laws.

4) Security and Retention

We use physical, technical, administrative, and organizational safeguards designed to protect personal information. No internet transmission or storage system can be guaranteed completely secure.

Data Retention: Yumciti retains customer account information, order history, transaction records, and associated personal information unless a customer requests deletion by emailing info@yumciti.com. We will review and respond to deletion requests in accordance with applicable law. Certain information may be retained where required or permitted for legal, accounting, fraud prevention, dispute resolution, or other legitimate purposes.

5) Your Privacy Rights and Options

You may contact Yumciti at info@yumciti.com to request access to or correction of your personal information, or to inquire about your privacy rights. Depending on applicable laws, you may also have the right to request deletion of your personal information. We will review and respond to such requests in accordance with applicable legal requirements. Certain information may be retained for legal, accounting, fraud prevention, or other permitted purposes.

6) Do Not Track (DNT)

Some web browsers include a Do Not Track (DNT) setting. Yumciti does not currently respond to DNT browser requests.

7) Other Service Providers

We may engage service providers to deliver the Services on our behalf, perform service-related tasks, or assist in maintaining our platform. These providers may access personal information as necessary to perform services for us, subject to applicable contractual and legal safeguards.

Payments

We use third-party payment processors to handle card transactions. Customers may reuse payment methods from prior orders. Yumciti retains the payment method unique identifier (GUID) and last four digits of the card for this purpose and for transaction records. Yumciti does not store full payment card numbers or CVV security codes. Payment processors handle card data under their own policies and applicable payment security requirements.

8) Age

Yumciti is not generally restricted to customers aged 18 or older. Our Services are not directed to children under 13, and we do not knowingly collect their personal information without any consent required by applicable law. Alcoholic beverages may be purchased only by customers who meet applicable age requirements, including age 21 where required, and restaurants may verify identification at pickup.

9) Third Party Sites

Our Services may include links to third-party websites that are not controlled by Yumciti, such as when you sign up for a loyalty program on a Merchant’s website. These third parties operate independently, and we are not responsible for their privacy policies or practices. Any Personal Information you provide to these third parties or through their websites will be governed by their respective privacy policies and practices.

10) Privacy Laws

Some of the information we collect and use is subject to specific state and federal privacy laws. When we receive your Personal Information that falls under these laws, we may be legally or contractually required to comply with them. In the event of a conflict between this Privacy Policy and applicable privacy laws, the privacy laws will take precedence.

11) California Privacy Rights

California residents may have rights under the California Consumer Privacy Act (CCPA), as amended, where applicable. These may include rights to know or access personal information, correct inaccurate information, request deletion, and exercise other applicable rights without unlawful discrimination. Some requests and information are subject to legal exceptions.

Information shared with restaurants: Yumciti provides participating restaurants with customer names, phone numbers, email addresses, delivery addresses, and order information or history for order fulfillment, customer service, and restaurant operations. Restaurants may also use contact information for promotional communications subject to applicable consent and opt-out requirements.

Sale and advertising-related sharing: Based on Yumciti's current practices, Yumciti does not sell customer personal information or disclose customer information to third-party advertising platforms for cross-context behavioral advertising.

We may periodically update this Policy to reflect changes in how we collect and process your Personal Information.
